The 1995 Settlement Agreement between the State of Idaho and DOE settles Idaho concerns that they were being used as a dumping ground for nuclear fuel waste that originated outside the state.

Admiral DeMars was a cosigner of the agreement. The agreement was signed on October 17. 1995 and is officially called "1995 Settlement Agreement and Consent Order in the matter entitled Public Service Company of Colorado v. Batt, CV-91-0035-S-EJL and CV 91-0054-S-EJL" Batt was the Governor of Idaho.


The agreement:

  • Allows the DOE and Navy to bring limited amounts of spent nuclear fuel into Idaho for 40 years

  • Requires DOE to expedite the treatment and permanent removal of waste and spent nuclear fuel from the state

  • Prevent shipments of spent nuclear fuel to the Idaho National Laboratory (INL) for permanent storage

  • Requires removing transuranic waste from Idaho

  • Requires treating and removing certain high-level waste streams from the state

  • Requires transferring spent nuclear fuel from wet storage to dry storage by 12/31/2023 unless a subsequent agreement is reached



There was a 2004 Addendum to the agreement addressing Spent Nuclear Fuel .
